Terms and Conditions

Data from an independent market research agency Market share report for April 2015 to March 2016, for category - 'Skin cream', SS category - 'Fairness', and sub category - 'Face Moisturizer'. Moving Annual Trend (MAT) data for this period is to be used from this report.
Adult A person of 18 years of age or above as on the date of making a Claim
BIS Bureau of Indian Standards for Skin Cream [IS 6608: 2004] (used for purposes of this Challenge for classification of Skin Creams). Please refer to specific BIS standards alluded to in this case.
Brand Variant All Products under Brand based on either Variant or SKU level in the data from an independent market research agency report which qualify as per the T&C of the Challenge
Challenge This Fair and Lovely Fairness 5 crore Instant Fairness Challenge 2016, by whatever name called
Challenge period The period between May 15, 2016 to August 31, 2016 (both days included) within which a Claimant is required to enter the Claim on the Claim web-site
Claim A Claim entered on the Claim website by the Claimant claiming that his/her Claimed Cosmetic Fairness Skin Cream meets the Challenge criteria as per the Terms and Conditions of the Challenge
Claim form A standard format to be filled in with all requisite details, available only on the Claim web-site
Claim web-site The web-site www.fairandlovely.in on which all Claims must be entered in order to be considered
Claimant Any Indian citizen of 18 years of age or above as on the date of entering the Claim on the Claim web-site, who is an actual user of the Claimed Cosmetic Fairness Skin Cream, and who enters a Claim on the Claim web-site by accepting the terms and conditions of the Challenge
Cosmetic 'Cosmetic' in India is defined under the Drugs and Cosmetics Act & Rules of India as any article intended to be rubbed, poured, sprinkled or sprayed on, or introduced into, or otherwise applied to, the human body or any part thereof for cleansing, beautifying, promoting attractiveness, or altering the appearance, and includes any article intended for use as a component of cosmetic. This includes only those products approved for manufacture and free sale under a cosmetic license in India, by the FDA authorities. By definition, this does not include any OTC products, Drugs, Medicines, Ayurvedic Proprietary medicine(s), or any products registered other than as BIS Creams with the relevant FDA.
Claimed Cosmetic Fairness Skin Cream The brand of Cosmetic Fairness Skin Cream entered by a Claimant on the Claim web-site to participate in the Challenge. This does not include any product manufactured, marketed or sold by HUL, any imported product, any cream which does not meet the specified Challenge criteria, any Ayurvedic product, any drug, or any bleach-based cream.
Cosmetic Fairness Skin Cream Any Cosmetic Fairness Skin Cream compliant to BIS standards for Skin Creams [IS 6608 : 2004], marketed in India for women, meant for external application and for individual usage. For removal of doubt, it is clarified that this term specifically excludes skin creams specifically designed, targeted and / or advertised as products for men.
Expert panel/Jury A team comprising of independent technical experts as appointed by HUL who will take a final decision on every Claim received on matters relating to validity of claim and winner determination.
Indian Citizen As defined under The Citizenship Act, 1955
Fair and Lovely Fair and Lovely advanced multi vitamin cosmetic fairness skin cream marketed for women. It does not include any other variant of Fair and Lovely.
Instant Fairness It is fairness achieved via coverage based on an average improvement or increase in the L*value on #50 bio-skin plate (from Beaulax Co., Ltd.) as measured by Minolta Spectrophotometer CM 2600d at 60 seconds post application a Cosmetic Fairness Skin Cream in D65 light source under SCE mode from 4 different points. Superior Instant fairness is an average improvement or increase in L* value > 1.
Fairness Measurement Time Measurement of Fairness in 1 minute post application of the Claimed Cosmetic Fairness Skin Cream as per Usage Protocol i.e., instrumental measurements of skin color carried out before (baseline) and in 1 minute post product application with Minolta spectrophotometer CM2600d.

Skin Cream As per BIS standard for Skin creams, a skin cream is described as: The skin cream shall be in the form of a thick emulsion or unctuous mass with a pleasant odour. It shall be white or pigmented or of uniform color. The Skin cream manufactured in India should have a valid Cosmetic manufacturing license from State FDA as per the Drugs and Cosmetic Act and Rules of India and should comply with the BIS standard for Skin cream [IS 6608 : 2004]
T&C These Terms and conditions, as amended from time to time
Usage Protocol Apply product on whole 50# Bio skin plate (BSP, from Beaulax Co., Ltd.) at the dose of 2mg/cm^2 (equal 20 micron film thickness); Measure the L* value with spectrophotometer CM-2600d (from Konica Minolta, JP) in D65 light source under SCE mode at 4 different points.
Valid Claims Claims which are entered on to the Claim web-site and found by HUL to be complete, correct and complying with the T&C of the Challenge as determined by HUL and / or Expert Panel / Jury

HUL claims that no Cosmetic Fairness Skin Cream commercially manufactured and sold in India at a brand average price between Rs. 250 to Rs. 350 per 100 grams as per the Data from an independent market research agency report, with specified market share as defined by these Terms and Conditions, provides superior Instant Fairness than Fair and Lovely.

Adult Indian citizens who are users of Cosmetic Fairness Skin Cream commercially manufactured and sold in India at a brand average price between Rs. 250 to Rs. 350 per 100 grams as per the Data from an independent market research agency, with specified market share as defined by these Terms and Conditions are eligible to participate in the Fair and Lovely Instant Fairness Challenge 2016 during the Challenge period.

HUL proposes to pay Rs. 5 crores to the first Indian Adult citizen who is a user of Cosmetic Fairness Skin Cream commercially manufactured and sold in India at a brand average price between Rs. 250 to Rs. 350 per 100 grams as per the Data from an independent market research agency, with specified market share as defined by these Terms and Conditions and who is able to disprove the Claim in accordance with the Terms and Conditions of the Challenge.

  • The Claimed Cosmetic Fairness Skin Cream which is eligible to be entered in this Challenge by the Claimant must comply with all the following criteria:

    • The Claimed Cosmetic Fairness Skin Cream must conform to BIS standards
    • The Claimed Cosmetic Fairness Skin Cream must provide superior Instant Fairness than Fair and Lovely, at the Fairness Measurement Time and by following the Usage protocol defined in these Terms & Conditions, and as adjudged by the Expert panel/Jury
    • The Claimed Cosmetic Fairness Skin Cream should be sold at a brand average price between Rs. 250 to Rs. 350 per 100 grams as per the Data from an independent market research agency report for March 2016, and have a PKD date between April 2015 and March 2016
    • The Claimed Cosmetic Fairness Skin Cream must be manufactured and commercially sold in general trade / retail outlets in India during the period April 2015 to March 2016 with specified market share as defined below:

      • a market share by value of 1% or more at brand level as per the data from an independent market research agency report, and
      • a market share by value of 0.2% or more at the SKU level as per the data from an independent market research agency report
    • The Claimed Cosmetic Fairness Skin Cream must be used alone i.e., without the addition of any chemicals / acid / bleach / other additives / other fairness cream or product(s)
    • The Claimed Cosmetic Fairness Skin Cream must be for external use only
    • The Claimed Cosmetic Fairness Skin Cream cannot be an imported brand / packaged Cosmetic Fairness Skin Cream
    • The Claimed Cosmetic Skin Cream should be manufactured in India under a valid Cosmetic manufacturing license from State FDA as per the Drugs and Cosmetic Act and Rules of India and should comply with the BIS standard for Skin cream [IS 6608 : 2004]
  • Any Skin Creams other than Fair and Lovely, marketed and / or sold by Unilever or any of its entities, are excluded from this Challenge i.e., it cannot be entered as a Claimed Cosmetic Fairness Skin Cream
  • The Challenge is open to any Indian Adult citizen, currently residing in India.
  • The Claimant must have a valid Permanent Account Number card to participate in this Challenge
  • HUL employees and their families, agents and business partners directly or indirectly related to HUL or their contractors are not eligible to participate in the Challenge, and can be excluded at any time such a relationship comes to the notice of HUL.
  • Companies, partnerships, HUFs, NGOs, and other forms of legal entities cannot participate
  • An individual person can participate only once as Claimant. Multiple entries by the same person will result in disqualification of all entries.
  • Joint entries are not permitted i.e., only one Claimant can enter a Claim
  • Any person who undertakes the Challenge does so of his or her free will. There is no compulsion to take this Challenge. The person understands that participation in the Challenge will only be driven by these T&C (as amended from time to time) and therefore agrees to the same at the time of participation.
  • This Challenge is open during the Challenge period only and the Claim along with the Slogan and mandatory documents must be successfully uploaded and submitted on the Claim web-site during the Challenge period as per the procedure laid down in these T&C and as mentioned on the Claim web-site.
  • The Challenge or the Challenge period may be amended at the discretion of HUL management without prior notice. This could include extending the Challenge, or curtailing it.

The following clauses define the process of lodging a Claim, which must be followed by the Claimant. Any deviation from the defined process will render the Claim disqualified.

  • The Claimant must read, understand and agree to accept all the Terms and Conditions of participation, prior to submitting the Claim and even otherwise, once the Claim is submitted, no dispute can be raised later on the Terms and Conditions and the process adopted
  • The participation in the Challenge shall be made only through an online Claim form on the Claim web-site in English language. Any other mode of submission of Claim shall be deemed to be invalid. Any incomplete or incorrect or unclear information / documents / photographs will render the Claim disqualified
  • The Claimant must fill the Claim form on the website with correct details and press submit button.
  • On receipt of the unique Claim reference number, the Claimant along with the required mandatory documents / copies / photographs as requested on the Claim confirmation page, must be emailed to <fairandlovely.india@unilever.com> within the 15 days from the date of submission of the Claim form on the website. HUL will not entertain any Claim supporting received after 15 days. HUL will also not entertain any Claim received through any other mode / medium
  • All the documents submitted in the Claim form on the Claim web-site shall be required to be produced in original (if required) by the Claimant on request, and only upon verification of their authenticity, the Claim shall be considered as valid and the Claimant will be allowed to participate further
  • HUL is not responsible for loss or non-receipt of Claims, or delayed receipt of Claims, or Claim web-site down-time for technological or any other reasons
  • Claims and its supporting documents once submitted cannot be modified / replaced
  • Claim lodging process would be deemed to be completed by Claimant only once a unique claim reference number is provided to the Claimant on the Claim web-site
  • HUL does not take any responsibility if the website is not working on any day, for reasons which are beyond its control

All Claims received will follow a defined process, as mentioned below, to determine if they are complete, accurate and aligned with the T&C of this Challenge. This process is not subject to being queried or changed by any Claimant. This process as defined by HUL shall be final & binding and cannot be questioned in any manner what so ever.

All Valid claims received will be sorted by the different brands of Claimed Cosmetic Fairness Skin Creams (CCFSC). Once the above has been determined, the first valid Claimant per each qualifying Claimed Cosmetic Fairness Skin Cream will be sent a letter inviting the Claimant to visit HUL office and view the results of the tests performed by HUL for Fair and Lovely and other brands which are eligible as per the T&C of the Challenge. The Challenge will end at this point, if the test data is able to satisfactorily prove the Claim made by HUL. However, if the Claim is not proven to the satisfaction of the Claimant, then a test as per the Usage Protocol shall be conducted in the presence of an external auditor, and Instant Fairness shall be examined at the Fairness Measurement Time.

For purposes of inviting the first valid Claimant per brand of Claimed Cosmetic Fairness Skin Cream, the following process shall be ensured:

  • The first valid Claimant per Valid brand will be called to the HUL office and be shown existing test results for the tests already performed by HUL. Determination of the first valid Claimant shall be on the basis of the first Claimant who completes the Claim Form, and whose Claim is found to be a valid Claim.
  • If the Claimant selected to be present cannot come for the testing, he will be replaced by next Claimant who has made a valid Claim for the same brand, for the purpose of viewing the testing procedure. The Claimant cannot send a representative in her stead.
  • If the Claimant is not satisfied with the test results as shown, then HUL shall conduct a test in front of the Claimant, for the Claimed Cosmetic Fairness Cream, as per the Usage Protocol, and evaluate the Instant Fairness as mentioned above, on a panel of with skin tone as mentioned in the defined Usage Protocol as per the T&C of the Challenge.
  • HUL will reimburse a reasonable amount for travel and stay costs incurred by selected Claimants for witnessing the test
  • The validity of the selected Claims will be determined based on test results submitted by HUL to the Claimants, as per the process mentioned in these T&C. A winner will be one whose Claimed Cosmetic Fairness Skin Cream shows superior Instant fairness than that provided by Fair & Lovely. HUL reserves the right to provide existing test data or data generated after the closure of the Challenge for evaluation by the Expert Panel / Jury. The decision of the Expert panel is final and binding in the matter of winner determination and interpretation of test results.
  • All Valid Claims received will be considered for determination of one winner (if any) of this Challenge and the same shall be determined on the basis of the earliest time and date on which the Claim was entered on the Claim web-site. In the event there are more than one Claims which are determined as Valid, then selection of the winner will be on the basis of the selecting the best Slogan as entered by the respective Claimants during the Claim logging process. Slogan determination will be done by an Expert panel/Jury.
  • The Challenge comes to an end once one winner is determined under these T&C, or at the end of the defined Challenge period if no valid claims are received, or if all valid Claims against all Valid Claimed Cosmetic Creams are unsuccessful in beating the Instant Fairness delivered by Fair and Lovely, whichever is earlier.
  • The results of the Challenge shall be informed to relevant Claimants in due course through by email
  • HUL will pay one Valid Claimant only. Winning Claimant shall be paid a gross amount of Rs. 5 Crores (Rupees five crores only) and no other direct and/or in-direct costs as incurred by the Claimant in lodging the Claim will be paid or reimbursed
  • The aforesaid payments shall be subject to deduction of applicable taxes at the time of payment of winning gross amount
  • The winners' amount shall be paid by an account payee cheque / draft and shall be issued only in the name of Claimant as mentioned in the Claim form, within 30 working days from the date of determination of winning status (if any) and only upon signing a winner agreement with HUL.
  • The copyright in all documents submitted as part of this Challenge shall remain vested with HUL and HUL shall be entitled to use the same as and when required for advertisements, communication, etc without any further documentation / communication / approval from the Claimant
  • If at any time post completion of the period of Challenge it is determined by HUL or any other body that the winning Claim is fraudulent, all prize money paid will be returnable to HUL in total, immediately with an interest of 12% per annum
  • Prize money will only be paid out on completion of the entire process, and once the Claimant has signed the winner agreement
  • Communication by Claimant with the media, or manufacturers / marketers of competing Cosmetic Fairness Skin Cream brands, as regards their participation in this Challenge, the process, the outcome, or any other manner, will disqualify the Claim.
  • The information collected through this activity shall be stored and processed as per the Unilever Privacy Policy available at http://www.unileverprivacypolicy.com/en_gb/policy.aspx
  • The collected information shall only be retained only for the purpose of this Challenge, and shall be deleted thereafter.
  • HUL and its auditing and implementation partners only will access to the information submitted by the Claimants, and such information shall not be shared with any other person or party, whatsoever.
  • The Claimants understand and acknowledge that the information shared by them may be transmitted to a server which may not be located in India, and the Claimants consent to such transfer, subject to stringent adherence to the Privacy Policy norms and all applicable laws by HUL and its auditing and implementation partners.
  • The Claimants understand and agree that it would be their responsibility to ensure that all information shared with HUL is up to date and accurate. It would be the responsibility of the Claimants to ensure that any change in the information is updated by calling on 1800-10-22-221. If not such intimation is received from the Claimants, then it shall be deemed by HUL that all information shared is accurate and up-to-date.
  • The Challenge or its period may be amended at the discretion of HUL management without prior notice. This could include extending the Challenge, or curtailing it.
  • HUL reserves the right to close the Challenge at its discretion, any time during the period of the Challenge
  • HUL does not take responsibility for any allergy/ allergic reaction, redness, etc caused to any Claimant or participant in this Challenge.
  • The Challenge is only applicable within the national boundaries of India
  • Any of these T&C may be changed by Hindustan Unilever Ltd. without prior notice, prospectively or retrospectively, at its discretion
  • The decision of HUL management on all other matters regarding the Claims is final and binding on the Claimants
  • Participating in the Claim process in any manner is tantamount to agreeing to these T&C, as changed from time to time
  • HUL, its employees and its agents and contractors will not be responsible for Claims that are lost in transit (physical or electronic mode) or deleted or corrupt or not accessible in any manner
  • HUL will not be responsible if emails sent by HUL to Claimants or vice-versa as part of the Claim validation process are not received, or received late, by Claimants / HUL.
  • Claims will be accepted in English only
  • Claimant understands and agrees that mere inclusion in the Claim process does not entitle the Claimant to a prize or to any other form of consideration
  • Claimants and winner (if any) permit HUL free of cost, the use of their name, photograph and/or video footages and factual information about their Claim in public media
  • HUL , process advisors, and their contractors for this Challenge, will not be liable for any claims / disputes made by the Claimants in relation to the Challenge, process and protocol used
  • HUL does not take responsibility for any loss or damage (direct or indirect) that any person or Organization may suffer as a result of participating or attempting to participate in the Challenge, the Challenge being withdrawn or its T&C amended
  • HUL cannot and shall not be accountable / liable for any disruptions / stoppages / interruptions or cancellation of the Challenge due to matters beyond its control and for force majeure reason(s)
  • All disputes relating to or arising out of the Challenge shall be subject to the laws of India, and shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction at Mumbai, India
  • The Claimants agree that they shall hold harmless HUL, its employees, officers, contractors or other persons and shall defend them against any loss, claim, demands, costs, damages, judgments, expenses or liability arising out of or in connection with any or all claims whether or not groundless, that may be brought against HUL by any third party in connection with their Claim(s)

  • This Challenge is not a lottery or game of chance
  • Participating in this Challenge will require communication with the Participant, and communication related to the participation by every Claimant, and hence, Participant waives her national do not call directory rights for the purposes of this Challenge
  • If at any time, HUL is unable to reach the Participant, and makes three consecutive unsuccessful attempts, the Claim of such Participant will be disqualified. The same would apply for information requests made to any Participant, who does not respond within two weeks or such other time stipulated for response.
